FAQs

Startups

How long does the startup formation process take?

For standard entities, we typically complete registration and setup within 3 to 7 business days, provided founder KYC documents are submitted promptly.

Do you work with startups outside Nairobi?

Yes. We serve clients across Kenya and the diaspora. Identity verification and signing can be handled via secure digital workflows.

Are government and registry fees included?

Our legal fee is separate. Government fees and disbursements are billed at cost with transparent receipts.

How does the monthly legal retainer work?

We agree on a fixed monthly fee for ongoing compliance, contract reviews and advice, so you get predictable support without surprise hourly bills.

Data Protection

Do SMEs and schools in Kenya need to comply?

Yes. If you collect or use personal data (students, parents, staff, customers, vendors), you should implement appropriate measures under Kenya’s Data Protection Act.

What is the fastest way to become compliant?

Start with a practical audit, then a compliance pack: privacy notice, internal policy, key vendor DPAs, and a breach response playbook.

Do we need a Data Protection Officer (DPO)?

Some organisations should designate a DPO or responsible person depending on scale, risk and processing activities. We help you assess the best fit and implement the role without overcomplicating operations.

Can you help with incidents and ODPC requests?

Yes. We support incident triage, documentation, customer communications strategy, vendor coordination, and responses to regulator or third-party requests.

Employment & Labour Law

Do I need written contracts for all employees?

If someone works for you for more than 3 months, Kenyan law requires a written contract. It reduces confusion and protects both parties.

How should I handle a termination?

Focus on process and documentation: reasons, notice, hearing where needed, and proper letters. Skipping steps often triggers expensive claims.

Can employees sue for unfair dismissal?

Yes. Claims can be filed at the Employment and Labour Relations Court. Where procedure or reasons are unfair, courts may award compensation.

Do you represent both employers and employees?

Yes. We help employers build compliant HR practice and defend disputes. We also help employees enforce rights in unfair termination, discrimination, and benefits disputes.

Can disputes be settled out of court?

Often yes. Negotiation and mediation can be faster, cheaper, and better for reputations than litigation.

General Civil Litigation

Do you handle cases outside Nairobi?

Yes. We handle matters across Kenya and can work digitally for documents, instructions, and updates. Court attendance depends on the station and case needs.

Can we settle without going to court?

Often yes. Many disputes are resolved through negotiation or mediation. We assess leverage and risks early, and pursue a settlement strategy where it makes commercial sense.

How long does a civil case take?

It depends on the court station, complexity, evidence, interlocutory applications, and adjournments. We prioritize early resolution and strong case management to reduce delays.

What do you need from me to start?

A short timeline, key documents (contracts, invoices, messages, title documents), and your goal (settlement vs trial). We then do an early case assessment and recommend next steps.

Can I protect an idea in Kenya?

Ideas alone are usually not protected. Protection typically comes from documenting, controlling disclosure, and protecting expression or implementation (contracts, copyright, trademarks, patents/designs where applicable).

Do I need Terms & Privacy for my website/app?

If you operate a website/app or collect user data, you should have Terms and a Privacy Notice that match your product and compliance needs. We draft documents aligned to your real flows.

What’s the fastest way to protect a brand name?

A trademark search and filing strategy is usually the fastest route. We also help with brand usage rules, licensing, and enforcement where confusion is already happening.

Do you handle IP disputes and takedowns?

Yes. We handle demand letters, platform takedown strategy, negotiation, and litigation where needed, including passing off and trademark/copyright related disputes.

Land & Property Law

What’s the most important step before paying a deposit?

Due diligence. Confirm ownership, encumbrances, authenticity of documents, and any restrictions (including consent/approval requirements where applicable).

Can you help with transfers and registration?

Yes. We handle sale agreements, transfer documents, stamp duty coordination, consent processes, and registration follow-through.

Do you handle land disputes?

Yes. We handle dispute strategy, preservation steps, negotiations, and litigation where needed.

Do you handle leases and tenancy issues?

Yes. We draft and review leases, negotiate key terms, and advise on enforcement and dispute resolution.

Succession, Estate Planning & Trusts

Do I need a will to avoid family disputes?

A will is often the simplest starting point. In some situations, a trust or a combined plan is better depending on assets, dependants and risk.

Why are trusts popular in Kenya?

Trusts can help with structured inheritance, privacy, long-term family provision, protecting minors, and reducing conflict over control. The right structure depends on goals, assets and governance.

Probate vs letters of administration?

Probate generally applies where there is a valid will appointing executors. Letters of administration are typically for estates with no will, where administrators are appointed by the court.

Can succession disputes be settled out of court?

Yes. Many family disputes can be resolved through negotiation, mediation and structured consents, which often saves time, costs and relationships.
